Terms of Service — Naresonarq

The short version. By using Naresonarq, you enter into an agreement with Naresonarq LLC. Naresonarq is a wellness platform, not medical care. Subscriptions auto-renew until cancelled. You retain ownership of your data. We retain ownership of the Platform. Disputes are resolved through arbitration where permitted. The full terms are below.

1. Agreement and acceptance

These Terms of Service ("Terms") form a legal agreement between you ("you" or "User") and Naresonarq LLC, a Delaware limited liability company ("Naresonarq," "we," "us," or "our"), governing your access to and use of naresonarq.com, naresonarq.app, the Naresonarq mobile application, and any related services (collectively, "the Platform").

By creating an account, downloading the app, subscribing, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

2. Eligibility

To use the Platform, you must be at least 16 years old. By using the Platform, you represent that you are 16 or older. We do not knowingly allow users under 16 to create accounts.

If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. The service

Naresonarq is a personalized frequency platform that calculates a unique audible Hz value for each user based on five layers of input data including numerology, the Tzolk'in calendar, sacred geometry, and sidereal astrology. The Platform delivers personalized audio tracks, written readings, and related wellness content based on your profile data.

What Naresonarq is not

A medical device or healthcare service
A substitute for professional medical, psychological, or psychiatric care
A guarantee of any specific outcome, healing, or result
An emergency service or crisis support tool

Wellness disclaimer. Statements made about Naresonarq, its sound sessions, or its frequency content have not been evaluated by the U.S. Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease. Naresonarq does not provide medical advice and is not a substitute for care from a licensed healthcare provider. Always consult your physician or qualified health professional regarding any medical condition or before beginning any new wellness practice. If you are experiencing a medical or mental health emergency, contact your local emergency services immediately.

4. Your account

You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized use
Providing accurate, current, and complete information

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are inactive for extended periods.

5. Subscription tiers and billing

Tier structure

Seeker (Free): Basic frequency calculation, one saved profile, one saved track. No payment required.
Adept (USD 7.77/month): Monthly readings, downloadable tracks, expanded chart features.
Oracle (USD 44.44/month): Weekly readings, multiple profiles, additional tracks, expanded interpretations.
Ascendant (USD 99.99/month): Daily readings, annual reading, full chart access, maximum profiles and tracks.

Billing terms

Paid subscriptions renew automatically each month until cancelled
You will be charged on the same date each month
Pricing is in US Dollars; international users may see currency conversions applied by their payment provider
Payment is processed through Google Play (Android), Apple App Store (iOS, when available), or our direct payment processor
You authorize us to charge your selected payment method for all fees

Cancellation

You can cancel your subscription at any time through your account settings, the app store where you subscribed, or by contacting hello@naresonarq.com. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

Refunds

Refunds are subject to the policies of the payment processor used. For purchases through Google Play or Apple App Store, refunds follow those platforms' policies. For direct subscriptions, we offer a 7-day refund window from the initial subscription date if you have not generated more than three personalized tracks. Email hello@naresonarq.com to request a refund.

Price changes

We may change subscription pricing with at least 30 days' notice. Existing subscribers will be notified by email before the change takes effect. If you do not agree to the new pricing, you may cancel before it takes effect.

6. Acceptable use

You agree not to:

Use the Platform for any illegal purpose or in violation of any law
Attempt to gain unauthorized access to any part of the Platform
Reverse engineer, decompile, or attempt to extract the source code or proprietary algorithms
Copy, reproduce, distribute, or create derivative works of the Platform content without permission
Use automated systems, bots, or scrapers to access the Platform
Share your account credentials with others
Resell, sublicense, or commercially exploit access to the Platform
Upload or transmit harmful, threatening, abusive, or unlawful content
Interfere with the operation of the Platform or its users
Misrepresent your identity or affiliation with any person or entity

7. Intellectual property

Naresonarq's rights

The Platform, including the five-layer calculation engine, the synthesis algorithm, the seven sacred geometry ratio sets, the interpretation content library, the brand identity, the Frequency Vessel symbol, and all related software, content, and design elements, is owned by Naresonarq LLC and is protected by copyright, trademark, trade secret, and other intellectual property laws.

The trademark NARESONARQ is the property of Naresonarq LLC (USPTO Serial 99819813, International Class 009).

Your rights

You receive a personal, non-exclusive, non-transferable, revocable license to use the Platform for your own personal wellness and exploration during your active subscription or use of the free tier. This license does not transfer ownership of any part of the Platform to you.

Your content

You retain ownership of the personal data you provide. By using the Platform, you grant Naresonarq a limited license to use, process, and store your data solely for the purposes of providing the service described in these Terms and our Privacy Policy.

Generated frequency content

The personalized audio tracks, frequency calculations, and written readings generated for you are licensed for your personal use only. You may not redistribute, resell, or use them for commercial purposes without our written permission.

8. Privacy

Our handling of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you acknowledge that you have read and understood the Privacy Policy.

9. Third-party services

The Platform integrates with third-party services including Google Firebase (authentication), Hetzner Cloud (server infrastructure), Cloudflare (content delivery), and payment processors. Your use of these services is also governed by their respective terms and privacy policies. We are not responsible for third-party services or their content.

10. Disclaimers

The Platform is provided "as is" and "as available." Naresonarq makes no warranties, express or implied, regarding the Platform, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that the Platform will meet your requirements, be free of defects or errors, or produce any specific result.

The personalized frequencies, readings, and audio content generated by the Platform are intended for wellness exploration and self-reflection. They are not advice, predictions, or guarantees. Your interpretation and application of any Platform content is your own responsibility.

11. Limitation of liability

To the maximum extent permitted by law, Naresonarq LLC, its members, managers, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for lost profits, lost data, business interruption, or personal injury arising from or related to your use of the Platform.

Our total cumulative liability to you for any claim arising from or related to these Terms or the Platform shall not exceed the greater of (a) the amount you paid to Naresonarq in the twelve months preceding the claim or (b) USD 100.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.

12. Indemnification

You agree to indemnify, defend, and hold harmless Naresonarq LLC and its members, managers, employees, contractors, and partners from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your violation of these Terms, your misuse of the Platform, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting hello@naresonarq.com or through your account settings.

Upon termination, your right to use the Platform ends immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and dispute resolution) will survive.

14. Governing law and dispute resolution

Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles.

Informal resolution

Before filing any formal claim, you agree to attempt to resolve disputes by contacting hello@naresonarq.com and allowing us 30 days to respond and resolve the issue.

Arbitration (US users)

For US users, any dispute not resolved through informal resolution shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Delaware. Each party shall bear its own costs and attorneys' fees.

You and Naresonarq waive the right to a jury trial and to participate in class actions. Disputes must be brought individually, not as part of a class or representative proceeding.

EU, UK, and international users

For users in the European Union, United Kingdom, and other jurisdictions where mandatory consumer protection laws apply, those laws override conflicting provisions in these Terms. You may have additional rights to bring disputes in your local courts, and we will not require arbitration if local law prohibits it.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email (if you have an account) and by posting a notice on the Platform. The "Last updated" date at the top indicates when the Terms were last revised. Continued use of the Platform after changes constitutes acceptance.

If you do not agree to revised Terms, you may terminate your account before they take effect.

16. Miscellaneous

Entire agreement

These Terms, together with the Privacy Policy and any subscription-specific terms, constitute the entire agreement between you and Naresonarq regarding the Platform.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

Waiver

Our failure to enforce any right or provision shall not be a waiver of that right or provision.

Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights to a successor entity in connection with a merger, acquisition, or sale of assets.

No agency

These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Naresonarq.
